17. SMS / Text Messaging Terms & Conditions
These SMS / Text Messaging Terms & Conditions (“Messaging Terms”) apply to the mobile text messaging program operated by Motorhomes of Texas (the “Program”), which is powered by our messaging provider, Intuit Mailchimp. By enrolling in, opting in to, or otherwise participating in the Program, you agree to these Messaging Terms and to our Privacy Policy.
17.1 Program Description and Consent
When you opt in to the Program, we will send you a message to confirm your signup. By opting in, you agree to receive recurring automated marketing and informational text messages (such as promotions, offers, appointment and service reminders, conversational replies related to your inquiry, and requests for reviews) from Motorhomes of Texas at the mobile number you provided. Automated messages may be sent using an automatic telephone dialing system or other technology to the mobile number you provided when signing up or any other number that you designate.
Your consent to receive marketing text messages is not a condition of any purchase.
17.2 Message Frequency
Message frequency varies, and additional messages may be sent periodically based on your interaction with Motorhomes of Texas. Motorhomes of Texas reserves the right to alter the frequency of messages sent at any time and to change the short code, phone number, or alphanumeric sender from which messages are sent.
17.3 Costs
Message and data rates may apply. Your usual message and data rates will apply to any message you send or receive through the Program. If you have questions about your text or data plan, please contact your wireless provider. Your wireless provider is not liable for delayed or undelivered messages.
17.4 Carriers
Carriers, including wireless carriers, are not liable for delayed or undelivered messages.
17.5 Opt-Out / Cancellation
You can cancel the Program at any time by texting STOP. Messages will also provide instructions to unsubscribe, either by replying STOP or through an included link. After you unsubscribe, we will send you a message to confirm that you have been unsubscribed, and no further messages will be sent. If you would like to rejoin the Program, simply sign up again as you did the first time, and we will resume sending messages to you.

If we include a link in a message we send you, you may also access instructions on how to unsubscribe and our company information by following that link.
17.7 Transfer of Number
You agree that, before changing your mobile number or transferring your mobile number to another individual, you will either reply STOP from the original number, unsubscribe using the link included in our messages (if one is provided), or notify us of your old number at info@motorhomesoftexas.com. The duty to inform us based on the above events is a condition of using the Program.
17.8 Privacy
The information you consent to share in connection with the Program is handled in accordance with our Privacy Policy. No mobile information (including your mobile opt-in data and consent) will be shared with third parties or affiliates for marketing or promotional purposes. Mobile opt-in data and consent are not shared with any third parties except for our messaging provider(s) solely for the purpose of enabling and operating the Program.
17.9 Changes to the Messaging Terms
We reserve the right to change or terminate the Program at any time. We also reserve the right to update these Messaging Terms at any time. Such changes will be effective immediately upon posting. If you do not agree to a change to these Messaging Terms, you should cancel your enrollment in the Program. Your continued enrollment following any change constitutes your acceptance of that change.
18. General Provisions
18.1 Governing Law and Venue
These Terms and any dispute arising out of or relating to them or to the Website are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute not subject to individual resolution will be the state and federal courts located in Nacogdoches County, Texas, and you consent to the personal jurisdiction of those courts.
18.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. No waiver will be effective unless in writing and signed by an authorized representative of Motorhomes of Texas.
18.4 Entire Agreement
These Terms, together with our Privacy Policy and any agreements you enter into with us (such as a purchase, financing, or consignment agreement), constitute the entire agreement between you and Motorhomes of Texas regarding your use of the Website and supersede any prior agreements on that subject.
